⚠️ PLEASE READ CAREFULLY: These Terms of Service constitute a legally binding agreement between you and Aviatec Global LLC. By accessing, registering, or using PilotQuizz, you agree to be bound by these Terms. If you do not agree, do not use our platform.

1. Acceptance of Terms

By accessing, registering, or using the PilotQuizz platform ("Platform") at www.pilotquizz.com, you ("User," "you," or "your") agree to these Terms of Service ("Terms") and our Privacy Policy and Legal Disclaimer, each incorporated herein by reference. These Terms are entered into between you and Aviatec Global LLC, a limited liability company organized under the laws of the United States.

2. Description of Service

PilotQuizz is an online aviation study and preparation platform providing educational content, interactive modules, quizzes, and study tools related to FAA regulations, EASA standards, AFAC requirements, aircraft systems, meteorology, and other aviation topics.

It does NOT constitute official aviation training, certification, or regulatory compliance documentation. Always refer to official FAA, EASA, AFAC, ICAO publications and certified flight instructors for authoritative guidance.

3. Eligibility

To use PilotQuizz, you must:

Be at least 18 years of age.
Have the legal capacity to enter into binding contracts in your jurisdiction.
Not be prohibited from using the service under applicable laws.
Provide accurate, complete, and current registration information.
Not be a former user whose account was terminated for Terms violations.

4. User Accounts & Security

You are solely responsible for:

Maintaining the confidentiality of your account credentials.
All activities that occur under your account.
Notifying us immediately of any unauthorized access at support@pilotquizz.com.
Not sharing your account or credentials with any other person.
Ensuring your registered email address is accurate and accessible.

Account data storage: Your account and progress data are stored locally in your browser's localStorage. This means data is device- and browser-specific. Clearing browser data or using a different browser will require a new account registration. We are not responsible for loss of data due to browser clearing.

We reserve the right to terminate accounts that violate these Terms, without refund.

4a. Multi-Device Session Policy (2-Device Maximum)

🚨 SUBSCRIPTION ACCESS RESTRICTION: Each paid subscription (Premium or Annual) is licensed to one (1) natural person and may be active on a maximum of two (2) personal devices simultaneously (e.g., your laptop and your phone).

The following rules apply to all paid subscription accounts:

Maximum 2 active sessions: You may be logged in on up to 2 devices at the same time. A third login attempt will automatically block the oldest active session and trigger a security alert email to your registered address.
No credential sharing: Sharing your username and password with any other person — whether for compensation or for free — is strictly prohibited and constitutes a material breach of these Terms.
Monitoring: We use device fingerprinting (a non-PII hash of browser timezone, language, platform, and screen resolution) and session token tracking to detect concurrent multi-user access patterns indicative of unauthorized sharing.
Security alerts: When a login from a 3rd device is detected while 2 sessions are already active, we automatically send a security alert email to your registered address. If you did not authorize the login, change your password immediately and contact support@pilotquizz.com.
One aircraft per subscription: Each paid subscription covers access to all study materials for one (1) aircraft type of your choice (e.g. Boeing 737, Airbus A320, CRJ-200, EMB-175, E195-E2, or Regulatory/FAA). To study an additional aircraft type, purchase a separate subscription at the same plan price. There are no aircraft-change fees — each aircraft type is an independent subscription.
Group/Organizational use: Airlines, flight schools, or organizations requiring simultaneous access for multiple users must purchase a group plan. Contact support@pilotquizz.com for group pricing.

Consequences of violation: Accounts found to be sharing credentials or exceeding the 2-device limit will be suspended immediately without refund. Aviatec Global LLC reserves the right to pursue civil damages for lost revenue resulting from unauthorized credential sharing.

5. Subscriptions, Payments & Plan Terms

PilotQuizz offers subscription-based access to premium content. By subscribing:

You authorize us to charge your payment method through Stripe on a recurring basis.
Subscriptions automatically renew unless cancelled before the renewal date.
All prices are in USD and subject to applicable taxes.
We reserve the right to change pricing with 30 days' notice to subscribers.
Failure to pay may result in suspension or termination of your account.
Each subscription covers all modules for one (1) aircraft type of your choice. To access a second aircraft type, purchase an additional independent subscription at the same price — no change fees apply.
Subscriptions are personal and non-transferable. See Section 4a for the 2-device maximum policy.

6. Intellectual Property Rights

All content on PilotQuizz — including but not limited to text, graphics, logos, icons, quiz questions, explanations, study materials, module content, software code, user interface design, and the overall "look and feel" of the platform — is the exclusive property of Aviatec Global LLC and is protected under:

United States Copyright Law (17 U.S.C. § 101 et seq.)
The Digital Millennium Copyright Act (DMCA)
U.S. and international trademark laws
Trade secret laws and other applicable intellectual property laws

7. Prohibited Conduct

🚫 STRICTLY PROHIBITED: The following activities are expressly forbidden and may result in immediate account termination, civil litigation, and/or criminal referral.

You agree that you will NOT:

Reverse engineer, decompile, disassemble, or attempt to derive the source code of the platform or any component.
Copy, reproduce, scrape, or extract any content, data, or materials without prior written consent.
Modify, adapt, translate, or create derivative works based on the platform or its content.
Remove, alter, or obscure any copyright, trademark, or proprietary rights notices.
Use automated tools, bots, scrapers, or crawlers to access, index, or collect data.
Attempt to gain unauthorized access to any platform systems or servers.
Distribute, sublicense, sell, or transfer access to the platform or your account credentials to any third party.
Share your login credentials with any other person or allow more than 2 concurrent active sessions on your account (see Section 4a).
Use the platform to build a competing service.
Use platform content to train, fine-tune, or build AI/machine learning models without explicit written authorization.
Circumvent, disable, or interfere with any security or access control features.
Perform penetration testing or vulnerability scanning without explicit written authorization.
Post, upload, or transmit any harmful, illegal, or infringing content.
Impersonate any person or entity or misrepresent your affiliation.

Violations may result in civil litigation under the Computer Fraud and Abuse Act (18 U.S.C. § 1030), the DMCA, and other applicable laws, including referral to federal law enforcement.

8. License Grant

Subject to these Terms, Aviatec Global LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use PilotQuizz for your personal, non-commercial educational purposes only. This license does NOT include the right to:

Resell or commercially exploit the platform or its content.
Download or copy content except as expressly permitted in writing.
Use the platform for any commercial, training, or instructional business purpose.

9. Aviation Disclaimer — Critical Safety Notice

⚠️ CRITICAL DISCLAIMER — READ CAREFULLY:

PilotQuizz content is NOT a substitute for official FAA-approved training, certified flight instruction, or regulatory authority publications. Aviation operations involve life-safety risks.

NEVER rely solely on PilotQuizz content for actual flight operations, emergency procedures, aircraft system operation, weather interpretation, or any regulatory compliance decision.

Always consult: your certified flight instructor, official AFM/POH, AIM, FARs, AFAC NOMs, EASA AMCs, ICAO annexes, and relevant competent authority publications.

The quiz questions and content in PilotQuizz are prepared by the Aviatec Global LLC editorial team for study purposes. They are NOT official examination questions from any regulatory authority and may not reflect the most current regulatory amendments.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AVIATEC GLOBAL LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AVIATEC GLOBAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Aviatec Global LLC, its officers, directors, employees, agents, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) your violation of any applicable law; or (e) any content you submit to or through the platform.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States of America, without regard to conflict of law principles. For users in Mexico, the LFPDPPP and applicable Mexican consumer protection laws also apply.

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) Commercial Arbitration Rules. You waive your right to a jury trial and class action participation. Small claims court actions under applicable thresholds are exempt from arbitration.

14. DMCA Copyright Policy

If you believe your copyrighted work has been infringed on our platform, send a DMCA takedown notice to support@pilotquizz.com including: (a) identification of the copyrighted work; (b) identification of the infringing material and its URL; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; and (e) a statement of accuracy under penalty of perjury, and that you are authorized to act on behalf of the copyright owner.

15. Termination

We may suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature survive termination (intellectual property, indemnification, liability limitations, dispute resolution, aviation disclaimer) shall survive.

16. Force Majeure

Aviatec Global LLC shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet outages, or third-party service failures.

17. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by email or prominent notice on the platform with at least 14 days' advance notice. Continued use after the effective date constitutes acceptance of the modified Terms.

19. Entire Agreement

These Terms, together with our Privacy Policy, Legal Disclaimer, and Refund Policy, constitute the entire agreement between you and Aviatec Global LLC regarding the use of PilotQuizz, superseding any prior agreements.
